Terms of Service

These Terms of Service (hereinafter referred to as the "Terms") set forth the terms and conditions for the use of Aitemasu. All registered users (hereinafter referred to as "Users") shall use this service in accordance with these Terms.

Article 1 (Application)

These Terms shall apply to all relationships between Users and Aitemasu regarding the use of this Service.

Article 2 (Registration)

• Registration shall be completed when a prospective user applies for registration in accordance with the method prescribed by Aitemasu and Aitemasu approves such application.
• Aitemasu may not approve an application for registration if it determines that the applicant falls under any of the following cases, and shall not be obligated to disclose any reasons therefor:
  • (1) When false information is submitted in the application for registration
  • (2) When the application is from a person who has violated these Terms in the past
  • (3) In any other cases where Aitemasu deems registration inappropriate

Article 3 (Management of User ID and Password)

• Users shall manage their user ID and password for this Service at their own responsibility.
• Users may not transfer or lend their user ID and password to any third party under any circumstances. Aitemasu shall consider any access and use of this Service made using a combination of user ID and password matching the registered information to be use by the User who registered such user ID.

Article 4 (Prohibited Actions)

Users shall not engage in any of the following actions when using this Service:

• (1) Actions that violate laws or public order and morals
• (2) Actions related to criminal activities
• (3) Actions that destroy or interfere with the function of Aitemasu's server or network
• (4) Actions that may interfere with the operation of Aitemasu's services
• (5) Actions to collect or accumulate personal information about other users
• (6) Actions to impersonate other users
• (7) Actions that provide benefits directly or indirectly to anti-social forces in relation to Aitemasu's services
• (8) Any other actions that Aitemasu deems inappropriate

Article 5 (Suspension of Service)

• Aitemasu may suspend or interrupt all or part of this Service without prior notice to Users if it determines that any of the following circumstances exist:
  • (1) When performing maintenance or updates on the computer system for this Service
  • (2) When the provision of this Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
  • (3) When computers or communication lines are stopped due to accidents
  • (4) In any other cases where Aitemasu determines that it is difficult to provide this Service
• Aitemasu shall not be liable for any disadvantages or damages suffered by Users or third parties due to the suspension or interruption of this Service, regardless of the reason.

Article 6 (Restriction of Use and Cancellation of Registration)

• Aitemasu may restrict the use of all or part of this Service or cancel the registration as a User without prior notice in the following cases:
  • (1) When any provision of these Terms is violated
  • (2) When it is discovered that false information was included in the registration details
  • (3) In any other cases where Aitemasu deems the use of this Service inappropriate
• Aitemasu shall not be liable for any damages incurred by Users due to actions taken by Aitemasu pursuant to this Article.

Article 7 (Disclaimer)

• Aitemasu's liability for breach of contract shall be exempted unless caused by willful misconduct or gross negligence of Aitemasu.
• Even when Aitemasu bears liability for any reason, such liability shall be limited to the scope of ordinary damages and, in the case of paid services, shall be limited to the amount of the fee (in the case of continuous services, the amount equivalent to one month).
• Aitemasu shall not be liable for any transactions, communications, or disputes between Users and other Users or third parties regarding this Service.

Article 8 (Changes to Service Content)

Aitemasu may change the content of this Service or discontinue the provision of this Service without notice to Users, and shall not be liable for any damages incurred by Users as a result.

Article 9 (Changes to Terms of Service)

Aitemasu may change these Terms at any time without notice to Users when deemed necessary.

Article 10 (Notifications and Communications)

Notifications and communications between Users and Aitemasu shall be made in accordance with the method specified by Aitemasu.

Article 11 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer their position under the usage contract or their rights or obligations under these Terms to any third party, or provide them as collateral, without the prior written consent of Aitemasu.

Article 12 (Governing Law and Jurisdiction)

• These Terms shall be interpreted in accordance with the laws of Japan.
• The Nagasaki District Court shall have exclusive jurisdiction in the first instance over any disputes regarding this Service.
